Hours of work |
Since many years, we have been fighting to better define the workweek |
We have negotiated for all levels: -The scheduled work week shall be 37.5 hours -the scheduled work day shall be 7.5 consecutive hours, exclusive of a meal period. -The normal workweek shall be Monday to Friday inclusive. - Where operational requirements permit, the employee shall be granted two (2) consecutive days of rest during each seven (7) day period. |
Articles 38 |
Variable hours of work |
Employees may, upon agreement with their supervisor, have a different distribution of regular work hours. |
Variable hours of work Different distribution of regular work hours so long as the daily hours amount to 7.5. |
|
Overtime |
For many years we have been fighting for all levels to access overtime and that it be cashable . Only levels 5 to 7 get cash out their overtime The maximum overtime rate paid is 1x1/2 Levels 8 + are entitled to 1X1 and only in compensatory time |
We obtained (for all levels): Overtime pay: -a) normal workday: 1 1/2 for the first 7.5 overtime hours worked and double (2) time thereafter; b) days of rest: 1 1/2 for the first 7.5 overtime hours worked and double (2) time thereafter except, that when an employee is required by the Employer to work on two (2) or more consecutive and contiguous days of rest he shall be compensated on the basis of double (2) time for all hours worked on the second (2nd) and each subsequent day of rest; c) designated paid holiday: 1 1/2 for the first 7.5 hours worked and double (2) time thereafter; d) Holiday which is not his scheduled day of work, contiguous to a day of rest on which the employee also worked: double (2) time for each hour worked; e) where an employee is required to work a continuous period of overtime during which he becomes entitled to be paid at the double (2) time rate, the employee will continue to be paid at that rate until the conclusion of the overtime period; f) no employee will be required to work more than 24 continuous hours. An employee who works 16 or more continuous hours shall receive a rest of at least 12 hours before reporting back to work. Exclusion for overtime worked outside the headquarters area: -when travelling outside of their HQ area, shall be compensated at 1X1 - taken in the form of compensatory leave -in case of a voluntary or involuntary separation, the unused hours accumulated shall be paid at the employee’s daily rate of pay at the time of departure. Exclusion for social and cultural activities: - for work purposes shall be paid 1x1 - taken in the form of compensatory leave. -when an employee leaves the unused hours accumulated shall be paid at the employee’s daily rates of pay at the time of departure. |

|
Only applicable to levels 5 to 7 |
We obtained the application for all levels |
|
Overtime
|
Currently, when an employee level 8 + travels, the employee is paid 1x1, in compensatory time only. We believe they should be entitled to cash out at some point. |
We obtained for all levels: - for all hours of travel 1x1, with no cap - taken in compensatory time only - can be cashed out when the employee leaves |
|
Travelling Time
|
There is nothing in the collective agreement |
We were successful in including in the travelling time the time necessarily spent at each stop-over en route provided that such stop-over does not include an overnight stay. |
New |
Bereavement |
You are entitled to seven days of Bereavement Leave with Pay following the death of a member of your immediate family. We argued that the current definition of immediate family is too limited and the entitlement does not respond to the needs of all families. |
The definition of immediate family has been broadened to include a person who stands in the place of a relative for the employee, whether or not there is any degree of consanguinity (descendant) between such person and the employee. The Bereavement Leave with Pay for a person who stands in the place of a relative whether or not there is a degree of consanguinity is limited to once in their career in the federal public administration. |
Article 21.02 |
